Berkshire County Registry of Deeds

The Berkshire County Registry of Deeds is at 44 Bank Row in Pittsfield. Register Patsy Harris runs the office. The Registry records all land-related public documents for 32 cities and towns across Berkshire County. This includes deeds, mortgages, discharges, liens, plans, and UCC filings. The index starts in 1960 and images are available for most documents going back to the 1960s.

Berkshire County is the westernmost county in Massachusetts and borders New York State to the west, Vermont to the north, and Connecticut to the south. The Registry serves a spread-out area that includes the city of Pittsfield and 30 smaller towns. Some of the smaller towns have very few land transactions each year, so older records may require a direct visit to the office or a phone search request.

Recording Fees for Berkshire County Documents

The Berkshire County Registry follows Massachusetts state law for recording fees. These fees are the same at all registries in the state. A deed costs $155. A mortgage is $205. A discharge is $105. A homestead declaration is $35. A Declaration of Trust is $255. UCC filings are $75. Federal tax lien recordings are $5. Plan sheets are $105 per sheet. A Municipal Lien Certificate is $80. Certified copies of recorded documents are $1 per page.

The real estate excise tax is $4.56 per $1,000 of the sale price and is paid when a deed is recorded. This applies to all conveyances of real property in Berkshire County. Documents can be sent by mail to P.O. Box 1438 in Pittsfield, dropped off in person at 44 Bank Row, or submitted through an attorney or title company. The Registry accepts checks, money orders, and credit cards for payment.

Public Records Requests Across Berkshire County

Massachusetts MGL Chapter 66, Section 10 gives any person the right to request public records from government agencies in Berkshire County. This covers town and city clerks, police departments, school committees, and other public bodies. You can submit requests by email, mail, or in person. No reason is required.

Agencies must respond within 10 business days. For municipalities with more than 20,000 residents -- which includes Pittsfield in Berkshire County -- the first two hours of staff time for a request are free. Smaller towns must also provide some free staff time at state agency rates. Beyond the free period, agencies can charge up to $25 per hour. Copies cost no more than $0.05 per page.
